Psychiatrists are medical doctors qualified to write prescriptions for controlled substances. But a Grand Jury Indictment announced Tuesday by the U.S. Attorney’s Office for the Eastern District of Wisconsin alleges that the way Fond du Lac Psychiatrist John Whelan, and his nurse Tina Montezon, prescribed Buprenorphine, Ritalin, Xanax and Adderall went outside the course of a professional medical practice and wasn’t for a legitimate purpose. Instead, it’s charged that they conspired to distribute those controlled substances, and in addition, maintained a drug-involved premises, and made false statements to federal agents during the investigation.
The grand jury alleges that the defendants would give the prescriptions from a residence on Clinton Street in Fond du Lac on Saturdays in exchange for between $200 and $300 per prescription.
If convicted, Whelan and Montezon face up to twenty years in prison, up to three years supervised release, up to a $1 million fine and other assessments.
