No criminal charges will result from an officer-involved shooting between an armed suspect and a Fond du Lac County Sheriff’s deputy. The events unfolded last October 14th when a woman escaped being held against her will and sexually assaulted by 33-year-old Kyle Massie. Deputy Blaine Evans responded to the scene with K9 Officer Iro and stopped Massie in his car with a pit maneuver as Massie tried to drive back to his residence. That’s when Massie got out of his vehicle, pulled out an A-R style rifle and began exchanging shots with Evans, who fired first and released Officer Iro after Massie refused to obey commands. Massie sustained two non-life-threatening wounds while striking K9 Iro several times. Deputy Evans wasn’t hit, and Massie shot himself after crashing into the squad car, taking his own life.
Fond do Lac County District Attorney Eric Toney told a news conference that “There is no basis to consider or issue any criminal charge in this circumstance against Deputy Evans or any other law enforcement officer that assisted. I found that his actions were privileged, and self-defense.”
K9 Iro has since made a long recovery and is back on the job.
