A state appeals court has upheld a ruling that blocks the Kohler Company from building a new golf course near the shore of Lake Michigan.
Kohler wanted to trade some of its property near Kohler-Andrae State Park in order to build an 18-hole golf course. The Department of Natural Resources initially granted that permit in 2017, but an administrative law judge overturned that ruling in 2018, saying the DNR did not properly weigh environmental impacts before agreeing to the trade.
The appeals court ruling on Tuesday is the third ruling against the proposed golf course, but the issue isn’t entirely decided as Kohler can still appeal the decision before the State Supreme Court.
