The City of Plymouth plans to take action on Tuesday that would prohibit anyone under the age of 18 to purchase or possess cigarettes, tobacco, nicotine products or vaping devices anywhere in the city. Included within the definition of vaping devices are those that contain nicotine or other products (hemp, CBD and marijuana) for inhalation or consumption.
Reasons cited in the proposal for the need for the new regulations are that current City of Plymouth ordinances address neither vaping devices nor the possession of nicotine gum or lozenges under the age of 18. The proposal also cites the increasing use of hemp, CBD and marijuana based vaping devices that are not prohibited under current State law or local ordinance. Because current marijuana laws allow vape devices that are purported to contain less than the 0.3% Delta-9 THC, a loophole currently exists regarding those products and their use by minors in the City of Plymouth.
If passed during Monday night’s Committee of the Whole meeting, the modification will allow the police department to enforce not only the sale of tobacco, nicotine and vaping devices, but also the possession of these products by persons under the age of 18 years. The proposal comes with a recommended citation of $98.80, and a second or subsequent offense within one year at $187.00.
