BROWN COUNTY, WI (WTAQ-WLUK) – The Brown County Taxpayers Association is appealing the dismissal of its lawsuit over President Joe Biden’s student loan debt forgiveness plan.
The BCTA, working with the Wisconsin Institute for Law and Liberty, a conservative law firm, filed the appeal on Tuesday.
The lawsuit was initially filed a week ago, arguing Biden’s move violates the constitutional separation of powers because he made it without congressional approval; violates the equal protection doctrine because White House documents say the debt forgiveness is “more likely” to help “borrowers of color;” and violates the Administrative Procedures Act.
Two days after the suit was filed, federal judge William Griesbach tossed it out, saying the plaintiffs did not have legal standing to sue the Biden administration.
“WILL anticipated this outcome, and is well prepared to advance the rule of law to the Court of Appeals — even to the U.S. Supreme Court, if need be. The President must be held accountable for his overreach of power,” Rick Esenberg, president and general counsel of WILL, said in a news release.
No hearings have been scheduled yet before the Seventh Circuit Court of Appeals in Chicago.
