The primary election is now behind us, but the battle over the way ballots can legally be handled is only stepping up in advance of the November general election.
In the latest volley, the Legislature’s Joint Committee for Review of Administrative Rules on Thursday filed to intervene in the “White vs WEC” case in Waukesha County Circuit Court, asking for a temporary injunction to immediately block any further guidance on ballot curing to clerks.
The Wisconsin Elections Commission issued an emergency rule in 2016 allowing clerks to fix errors on ballot certificates and envelopes that would render the vote invalid. But ballot curing isn’t allowed under state statutes which instead allow only two options: have the voter themselves fix the error, or reject the ballot.
In making the court filing, Senate Majority Leader Devin LeMahieu of Oostburg said, quote: “Lawless ballot curing cannot and will not be allowed to continue. We’re putting the full weight of the Legislature behind this lawsuit to shut down WEC’s defiant and flagrant abuse of the law.”
LeMahieu said the goal is to resolve the issue far in advance of the November 8th General Election.
