Sheboygan County Circuit Court Judge Edward Stengel has upheld the ruling of an Administrative Law Judge who, in 2019, threw out a decision by the Wisconsin DNR to grant a permit to Kohler to fill wetlands in order to construct a golf course in Black River. Kohler had appealed that move to the Sheboygan County Circuit Court, but the decision issued on Friday dismissed Kohler’s case, and “concluded that the original decision to issue the wetland permit was not based on scientific facts and definitive plans, but speculation and promises.”
The permit was challenged by the grassroots group, “Friends of the Black River Forest”, which has argued that the DNR proceeded with approval of the permit despite factual inconsistencies and incomplete information..
Kohler had also argued that the Administrative Law Judge was compelled to impose conditions on the permit, rather than reverse it entirely, but that argument was also rejected by Judge Stengel in his 38-page decision.
