Senate Majority Leader Devin LeMahieu of Oostburg expressed his approval of the 4-3 ruling by the State Supreme Court on Wednesday that struck down Governor Evers’ extension of the state’s mask mandate as an unconstitutional use of executive power.
LeMahieu said that the ruling upholds the separation of powers and the rule of law, and that the ruling vindicates the Legislature as a co-equal branch of government.
The Legislature revoked Evers’ extension of a mask mandate in February, saying that the Governor didn’t have authority under the law to extend an emergency order beyond 60 days, and the court agreed.
While there’s no mandate now in place, LeMahieu expressed trust in the residents to follow CDC guidelines when appropriate, to get vaccinated when ready, and to always employ common sense.
