The City of Sheboygan has reached a settlement with the mother of 9-year-old Roman Martin who died when a City of Sheboygan garbage truck struck the boy as he rode his bike to school in October of 2019.
The incident was initially investigated by the Wisconsin State Patrol, which found neither the City nor the driver of the truck at fault, indicating that instead Martin failed to yield right of way and that he struck the truck. However a medical examiner report later found that the truck struck Roman in the crosswalk.
A Claim asking for $250,000 damages was then filed, and subsequently denied by the city, prompting the filing of a civil suit.
After mediation failed to resolve the issue last year, a trial was slated to begin this May. However, before that was set in motion the City negotiated a settlement with Roman Martin’s mother, Audrey Brubaker, authorizing the City Attorney to settle the matter for $94,191.51. That proposal was passed by the Common Council in Wednesday night’s meeting.
WHBL had reached out to the City Attorney’s office well in advance of last night’s meeting, but received no response.
