MADISON, WI (WTAQ) — The Wisconsin Institute for Law and Liberty will continue its lawsuit against the mask mandate extended Tuesday by Governor Tony Evers.
Founder Rick Esenberg says it’s still in violation of state law, which allows the governor to declare an emergency for a period of 60 days.
“The Governor cannot simply declare one emergency after another related to the same set of circumstances, in this case, the COVID-19 pandemic,” Esenberg told WTAQ’s ‘The Morning News with Matt and Earl’. “It’s appropriate for the government to take some action, but it doesn’t suspend the constitution and it doesn’t suspend state law.”
Governor Evers has declared three such emergencies in relation to the COVID-19 pandemic. The first, back in March, came alongside the “Safer at Home” order, which closed restaurants and retail stores throughout the state. The second, mandating masks throughout the state, was issued in July. The third, issued on Tuesday, extends July’s order.
WILL sued following the issuance of the second order. Their lawsuit is still pending.
