Appeals court denies motion to stay Act 10 union election order


MADISON, Wis. (WSAU) - The Appeals Court has issued a ruling on Act 10.

The court today ruled against the motion to stay Judge Juan Colas’ orders, including the contempt of court findings against two state officials for proceeding with union certification elections against his order earlier this year.  That means there will be no union certification elections for now.

The Appeals Court acknowledged that the issue is likely to be decided at the Supreme Court, and weighed the options of which parties are damaged and how much if a stay is granted or denied. Judges decided against overturning Colas’ ruling. They said if the election statutes are found to be unconstitutional by the Supreme Court, negating the basis for union elections, the delay will cause no harm. They also say if the Supreme Court upholds the provisions for union elections in Act 10, the harm done would be limited to the time between now and when the Supreme Court acts.
