MADISON, Wis. (WHBL) - A nearly two year old Sheboygan County case may be headed to the State Supreme Court. The case involves 19 year old Andrew Edler of Waldo who was charged with two counts of arson in April of 2011. Edler was 17 at the time and one of the newest members of the Waldo Fire Department and became a suspect in two small arson fires because he arrived so quickly. The case came to a halt in 2011 when Judge Terrence Bourke granted a defense motion to suppress admissions made by Edler because police questioning violated his 5th amendment rights. The case centers on Edler saying “can I have an attorney present” and whether he was invoking his right to counsel or just asking about it. The Appeals Court has referred the case to the State Supreme Court saying these are important, undecided issues of federal and state constitutional law and should be decided by the Supreme Court.
