MILWAUKEE, WI (WSAU) - Steven Avery is back in court. The 50-year-old man from Mishicot, who was wrongly convicted of rape, spent 18 years in prison, then cleared by DNA evidence, and later convicted of murdering Theresa Halback has been sued by the Halback family.
The civil damages case took years to get to court because it overlapped the criminal case, which was tied up in the appeals court after Avery was found guilty. Now that Avery has lost his appeal case, the civil case is proceeding.
Both Avery and his nephew, Brendan Dassey, are serving life terms for the murder of the 25-year-old photographer in 2005.
