OZAUKEE COUNTY, WI (WTAQ) - A Milwaukee area driver was sentenced to 10 years in prison Monday afternoon, for hitting and killing two elderly pedestrians on a street in Mequon – and then fleeing the scene.
37-year-old Daniel Fagan struck a plea deal last month in the deaths of 72-year-old Leonid Krol and his 69-year-old wife Emiliya, both of Brown Deer.
Fagan pleaded guilty to a pair of hit-and-run charges – and 2 counts of negligent homicide were dropped. That allows Fagan to be eligible for a supervised release in as early as 8 years. He must spend 14 years under extended supervision when he’s no longer behind bars.
Fagan has a history of drunk driving. But prosecutors said there was no evidence he was impaired when he struck the Krols.
In fact, had he not left the scene, Ozaukee County Circuit Judge Paul Malloy said Fagan might have gotten away with only a ticket.
District Attorney Adam Gerol said a bad curve, poor lighting, and the lack of a shoulder on the roadway all contributed to the crash.
